The Demise of Expert Witness Immunity

The Supreme Court has, in a recent decision, abolished the 400 year old principle whereby experts in legal proceedings have benefited from immunity from action being taken against them for breach of duty arising out of their participation in those proceedings.

“Cash for Claims” to be banned?

At the present time some Claims Management Companies primarily those dealing in personal injury claims, and indeed some firms of Solicitors offer their clients a cash incentive to place their claim with them.

The Ministry of Justice who are responsible for regulating Claims Management Companies published a consultation paper on the23rd of December 2010 wherein they propose to ban cash payments and other benefits being offered at any stage of a claim by Claims Management Companies as an incentive to bring a personal injury claim. Tempted to exaggerate or be fraudulent in your claim? Think again!

A Claimant Taxi Driver from Essex has pleaded guilty to being in contempt at the High Court in London after admitting that he was fraudulent in pursuing his claim for personal injury compensation.

The Claimant was pursuing a claim for personal injury compensation following his involvement in a road traffic accident back in 2006.  The Defendant  insurers, Aviva,  initially offered the taxi driver the sum of £17,500 to settle his claim for compensation on the basis that the injuries sustained by him  in the accident forced him into early retirement.
