Slipping and Tripping accidents can occur anywhere, from shops, cinemas, restaurants, clubs and pubs to footpaths and other outdoor spaces.  The owners and/or occupiers of the land/premises where you have been injured have an obligation to ensure your safety whilst you are on their land or in their premises.

A large majority of tripping accidents occur on local authority land, usually on footpaths. The local authority for the area where your accident occurred are normally responsible for footpaths (unless of course the land is private) and they have an obligation to maintain the footpaths in a safe condition for pedestrians and usually deal with this obligation by having a system of regular inspections in place to identify defects and ensure they are repaired in a timely manner.  Unfortunately due to budget constraints it is not always possible for the local authorities to meet their obligations in this regard resulting in defects occurring in pathways which are then left unrepaired.

Alternatively you may have slipped and fallen somewhere due to a spillage that the responsible party has failed to clean up or alert passersby of the danger.

Useful Tips

  • Report your accident to the party responsible for the accident location (local council, supermarket etc)
  • If the accident occurs in someone’s premises ask for it to be recorded in the accident book
  • Get the name of the person you reported the accident to
  • Take photographs of the accident location
  • In photographs of defects try to get some sense of scale in them
  • Seek appropriate medical treatment
  • Take photographs of your injuries and any items damaged in the accident
  • Get the details of witnesses to include names and addresses
  • Keep a record of your losses and expenses
