No Smoking

On 1st July 2007 virtually all enclosed public places and workplaces in England became smoke free.

Employers are required to display 'no smoking signs' in both premises and vehicles. Reasonable steps must be taken to ensure the staff, customers and members of the public are all aware of the law.

Vehicles that are used primarily for private use are exempt as are vehicles with sole users that are not used as a workplace by anyone else. However, shared vehicles such as those used by the delivery driver and his mate are not and the law applies even if the non-smoker is not present.

Three new offences have been created which are enforced by local authorities. Some of these offences may be eligible to be dealt with by way of fixed penalty. The offences are as follows:-

1. Failure to display 'no smoking' signs

2. Smoking in a smoke free building or vehicle

3. Failing to prevent smoking in a smoke free place
