"Special Contribution" can lead to departure from equality in finance cases |

The Court of Appeal has dismissed the appeal of the very wealthy Mr Charman against a decision which gave his wife of 28 years 36.5% of assets which totalled £131million. Whilst the Court stated that there should be equality of division between divorcing parties, if 1 party made a "special contribution" then this could lead to a departure from equality of between 5% and 16.6%. Special contribution can be non financial and financial. The Court also called for a complete overhaul of English financial provision law to take into account changes that have occurred in society over the last 30 years or so. |
